Terms of Service

1. Agreement to Terms

By accessing or using Portal's website (getportal.cc), API, SDK, or related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, do not use the Services.

2. About the Services

Portal Technologies Inc provides age verification technology that enables platforms to confirm that users meet a minimum age threshold, without collecting or storing personal identity data. The core product offers two verification methods:

Facial Age Estimation

Processes a short video selfie inside a sealed AWS Nitro Enclave
Uses AI to estimate whether the user meets the required age threshold
Retains no biometric data, no video, and no personal data

NFC Passport Verification

Reads the chip embedded in a user's biometric passport using NFC (Near Field Communication)
Verifies the passport's cryptographic signatures in accordance with ICAO 9303 standards
Extracts only the age-relevant data (date of birth) inside a sealed AWS Nitro Enclave
Retains no passport data, no chip contents, and no personal data

Both methods return a binary age verification result (verified / not verified) to the integrating platform. Neither method retains any personal data.

3. Eligibility

Platform Customers: You must be a legal entity or individual over the age of 18 operating a lawful business. Use of the Services for illegal purposes is strictly prohibited.

End Users: The age verification flow is available to all individuals, subject to the terms of the platform you are using Portal through.

4. Platform Customer Terms

4.1 API Access and Use

Portal grants you a limited, non-exclusive, non-transferable licence to use the Portal API and SDK to integrate age verification into your platform, subject to these Terms.

You agree to:

Use the Services only for lawful purposes and in compliance with applicable law
Not resell, sublicence, or redistribute the Portal API without written permission
Maintain the security of your API credentials and notify us immediately of any unauthorised access
Comply with applicable age verification regulations in your jurisdiction (including but not limited to the UK Online Safety Act 2023, EU Digital Services Act, and any applicable gambling, adult content, or alcohol regulations)

4.2 Acceptable Use

You must not use the Services to:

Facilitate illegal activity of any kind
Process verifications for purposes other than age-gating access to your platform
Attempt to reverse-engineer, circumvent, or tamper with the enclave verification process
Misrepresent Portal's capabilities or certifications to regulators or users

4.3 Your Responsibilities

As a Platform Customer integrating Portal, you are responsible for:

Obtaining appropriate consent from your users before initiating an age verification
Presenting accurate information to users about what the verification entails
Compliance with all applicable laws in the jurisdictions where you operate
Your own privacy policy and terms of service as they relate to your users

4.4 Fees and Payment

Fees for use of the Services are as set out on our pricing page or as agreed in a separate Order Form. Fees are payable in advance. We reserve the right to suspend access for non-payment after reasonable notice.

5. End User Terms

When you complete an age verification through a platform that uses Portal:

Facial Age Estimation: You consent to a short video selfie being processed by Portal's AI system for the purpose of estimating your age. The video is processed inside a sealed enclave and is not retained by Portal or the platform.

NFC Passport Verification: You consent to your device reading the NFC chip in your biometric passport. The chip data is processed inside a sealed enclave solely to verify your age. No passport data, chip contents, or personal information is retained by Portal or the platform.

In both cases:

The platform receives only a verified/not verified result — no other information about you
You must be the individual completing the verification — you may not complete a verification on behalf of another person
Portal is cryptographically incapable of linking any verification to any individual

6. Intellectual Property

Portal and its licensors own all intellectual property rights in the Services, including the API, SDK, enclave software, and documentation. These Terms do not transfer any ownership to you.

You retain ownership of any data you provide to Portal through the Services.

7. Confidentiality

Each party agrees to keep confidential any non-public information of the other party received in connection with the Services, and not to use such information for any purpose outside these Terms.

8. Warranties and Disclaimer

Portal represents that:

The Services will perform materially in accordance with the documentation
We will maintain appropriate technical and organisational security measures

THE SERVICES ARE PROVIDED "AS IS" TO THE MAXIMUM EXTENT PERMITTED BY LAW. PORTAL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AGE VERIFICATION RESULT IS LEGALLY SUFFICIENT FOR YOUR REGULATORY OBLIGATIONS. YOU ARE RESPONSIBLE FOR DETERMINING WHETHER THE SERVICES MEET YOUR COMPLIANCE REQUIREMENTS.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Portal's total liability to you for any claims arising under or in connection with these Terms shall not exceed the greater of:

The fees paid by you to Portal in the 12 months preceding the claim, or
$1,000 USD

In no event shall Portal be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity.

10. Indemnification

You agree to indemnify and hold harmless Portal Technologies Inc, its directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

Your use of the Services
Your breach of these Terms
Your violation of any applicable law or regulation
Any claim by a third party arising from your platform's use of Portal

11. Term and Termination

These Terms apply from the date you first access the Services. Either party may terminate upon 30 days' written notice. Portal may suspend or terminate access immediately if you breach these Terms or use the Services unlawfully.

Upon termination, your right to use the Services ceases immediately. Sections 6 (IP), 7 (Confidentiality), 9 (Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) survive termination.

12. Changes to These Terms

We may update these Terms from time to time. We will notify Platform Customers of material changes by email at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

For Platform Customers located in the EU or UK, nothing in this clause limits your rights under applicable local consumer protection laws.

14. General

Entire Agreement: These Terms constitute the entire agreement between you and Portal regarding the Services and supersede all prior agreements.
Severability: If any provision is found unenforceable, the remainder of the Terms continues in full force.
Waiver: Failure to enforce any provision does not constitute a waiver.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to any successor entity.
